1. Applicability

These Terms & Conditions (the “Terms”) apply to your access to and use of the website located at www.abbett.com (the “Site”) and any affiliated websites operated by Abbett, and your purchase of any products or services from the Site. By using the Site, browsing, placing an order or otherwise engaging with the Site, you agree to be bound by these Terms. If you do not agree to all of these Terms, then please do not use the Site.

2. Amendments to Terms

We reserve the right, in our sole discretion, to change, modify, or update these Terms at any time without prior notice. Any changes will become effective immediately when posted on the Site. Your continued use of the Site following such posting constitutes your acceptance of the amended Terms. It is your responsibility to review these Terms periodically.

3. Accessibility

We are committed to making our Site accessible and user-friendly for all users. If you experience any difficulty viewing or navigating the Site, or believe any feature is not fully accessible to individuals with disabilities, please contact us at help@abbett.com with “Website Accessibility” in the subject line. We will consider your feedback and work to improve accessibility. Note that we may rely on third-party vendors for some accessibility services.

4. Prohibited “Comparison Purchasing”

To help maintain fair inventory management and product availability, we may disallow purchases made solely for the purpose of comparison shopping (i.e., buying several items with the intent to keep one and return the others). If you wish to evaluate a product quality or fit, please contact our customer service at help@abbett.com for assistance.

5. Currency and Pricing

If the Site displays multiple currencies or automatically converts prices based on your location, you agree that we and/or our third-party service providers may determine your location via your IP address and store a session cookie in your browser for currency selection and consistency.
We strive to display accurate pricing and availability, but please note that errors may occur (see Section 7 below).

6. Discounts, Promotions & Special Offers

All coupon codes unless stated otherwise are not valid on Sale Items, Custom Orders, or services such as cleaning, repairs, and resizing. Only one discount code may be used per customer per order, and discounts may not be conjunction with other offers.

7. Lab grown diamond reports.

Customers that purchase lab grown diamonds with IGI grading reports will .also receive a link to the online certificate via email.

These grading reports are detailed documents created by diamond grading experts at highly-respected diamond laboratories. These diamond grading reports are extremely expensive to replace and as a result of this, Abbett requires each diamond grading report to be included with each returned diamond. If you do not include the diamond grading report with your return, you will be charged a replacement fee of two hundred and fifty dollars ($150.00).

8. Information on the Site; Product Availability & Pricing

We attempt to ensure the product descriptions, images, pricing and availability information on the Site are as accurate and current as possible. However:

• The appearance of products (including size, colour, shape) may vary due to monitor settings or customization.
• Product specs (size, weight, measurements, etc) may include tolerances or slight variations from those listed.
• Availability is subject to change without notice; if an item becomes unavailable after your order, we will notify you and provide options.
• Pricing or typographical errors may occur. We reserve the right to cancel or correct any order placed at an incorrect price, or require you to pay any difference if already shipped.

9. Policy on Ethical Sourcing

All of our diamonds, gemstones, and metals come free of any humanitarian or environmental concerns as they are either created in a regulated laboratory or sourced from a regulated recycled origin.

10. Product Availability and Pricing

The stock availability on our website is provided “as is” and is subject to change at any time. Due to the volume of orders we receive, certain items may go out of stock before we are able to update the Site. Should this occur, we will contact you directly to discuss available options, such as an alternative product or an updated delivery timeline.

From time to time, certain Abbett products may be discontinued, temporarily unavailable, or replaced with updated designs. Abbett reserves the right to discontinue any product(s) at its sole discretion whenever necessary. In the event that an Abbett product is discontinued or becomes obsolete, you may be offered a comparable replacement of equal value at no additional cost.

If you are interested in an item currently on back order, please contact us at help@abbett.com and we will be happy to provide an estimated restock date. Jewelry or other products previously available on www.abbett.com may be removed at any time at Abbett’s sole discretion.

We make every effort to ensure that the data, including pricing and product details, displayed on our Site is accurate. However, system, typographical, or technical errors may occasionally occur. Abbett reserves the right to correct any and all such errors and does not honor inaccurate or erroneous prices.

If a product’s listed price is lower than its actual price, we may, at our discretion, either:

• Contact you for confirmation before processing the order, or
• Cancel the order and notify you of the cancellation.

If your order has already shipped, you agree to either return the product or pay the difference between the actual and charged price.

All prices are subject to change without notice. We do not negotiate pricing on our products, and all prices are final.

11. Sales Items

All SALE items — including but not limited to engagement rings, wedding ring sets, loose gemstones, and earrings — are available ready-to-ship in new, unworn condition.

SALE items are not eligible for refunds, but may be accepted for exchange, provided the item has not been resized, altered, or customized in any way. Exchanges are only available for goods of equal or greater value than the item being exchanged.

Most engagement rings and wedding ring sets can be resized up or down approximately half a size. Please note that resizing will add approximately 4 business days to your estimated shipping date. Minor customizations, such as engraving, may also be available for an additional fee.

Coupons, discounts, and special promotional offers cannot be applied to sale items unless expressly stated otherwise.

12. Your Account and Order

When you access or use the Abbett website or your personalized Abbett account, you are solely responsible for maintaining the confidentiality of your account information, including your password, and for restricting access to your computer or device. You are also responsible for all activities that occur under your account and password.

If you are under the age of 18, you may use abbett.com only under the supervision of a parent or legal guardian.

Abbett reserves the right, at its sole discretion, to refuse service, terminate accounts, remove or edit content, or cancel orders at any time and for any reason.

In the event that a customer initiates a chargeback, Abbett reserves the right to recover any direct or indirect costs incurred, and to cancel any associated promotional items, discounts, free shipping, or other benefits, as determined at Abbett’s sole discretion.

13. Trademarks

Abbett, the Abbett logos, and any other product or service names or slogans displayed on our website are trademarks of Abbett and/or its licensors, and may not be copied, imitated, or used — in whole or in part — without the prior written permission of Abbett or the applicable trademark holder.

You may not use any metatags or any other form of “hidden text” utilizing “Abbett” or any other name, trademark, or product or service name of Abbett without our prior written consent.

All other trademarks, registered trademarks, product names, and company names or logos mentioned on our Site are the property of their respective owners.

14. Intellectual Property.

All materials on the Site — including text, graphics, logos, icons, images, designs, software, audio files, selection and arrangement of the materials — are proprietary to Abbett or our licensors, and protected under intellectual property laws.
You are granted a personal, non-commercial, non-sublicensable licence to access and use the Site for your own information only. This license does not permit you to:

• Resell or commercially exploit any part of the Site or its materials;
• Use any automated means (robots, spiders, scraping) to access, monitor or extract content;
• Download (except for page caching) or modify any portion of the Site;
• Reproduce, publish, distribute, display or create derivative works of materials without our prior written consent.

Unauthorized use of any of the Site materials may violate intellectual property laws and will result in termination of the licence granted herein.

15. Use of the Site

Your use of the Site must be lawful and must not interfere with or damage the Site or any system. You must not use the Site for any unauthorized purpose or attempt to gain unauthorized access to any part of the Site or other users’ accounts.

16. Repeat Infringer Policy

In accordance with the Digital Millennium Copyright Act (DMCA) and other applicable laws, Abbett reserves the right, at its sole discretion, to terminate or bar access to specific website users or Abbett account holders who, under appropriate circumstances, are determined to be repeat infringers.

Abbett also reserves the right to limit access to the Site and/or terminate the accounts of any users whom Abbett reasonably suspects of infringing the intellectual property rights of others — whether or not there has been any repeat infringement.

17. Third-Party Content & Links

The Site may contain links to third-party websites or services which are not owned or controlled by Abbett. We do not monitor or endorse the content of such third-party sites, and we are not responsible for any transactions, content, damages or liabilities arising from your use of them. Use of third-party links is at your own risk.

18. Advertisements and Promotions

Abbett may display advertisements and promotions from third parties on our website. Any business dealings, correspondence, or participation in promotions with advertisers other than Abbett, and any associated terms, conditions, warranties, or representations, are solely between you and the third party.

Abbett is not responsible or liable for any loss, damage, or dispute arising from such dealings or from the presence of any non-Abbett advertisers or promotions on our Site.

19. User Submissions & Interactive Areas

If you submit any feedback, ideas, suggestions, comments or other materials to us (whether via the Site, by email or otherwise), you hereby grant Abbett a worldwide, perpetual, irrevocable, royalty-free, sublicensable licence to use, reproduce, adapt, publish and distribute such submissions for any purpose, without acknowledgement or compensation to you.
You represent and warrant that you have the rights to submit such materials, that they are accurate, do not infringe third-party rights and are not prohibited content.

If the Site includes review features, forums or other interactive areas (“Interactive Areas”), you are responsible for your postings (“User Content”). By posting User Content, you grant us a non-exclusive, worldwide, royalty-free, perpetual, sublicensable right to use, reproduce, modify, publish, translate, create derivative works from, distribute and display your User Content in any media. You further warrant that you have all necessary rights to the User Content, it is accurate and does not violate these Terms or third-party rights.
You agree not to post content that is unlawful, defamatory, invasive, abusive, obscene, or otherwise objectionable. We reserve the right, at our sole discretion, to remove or refuse any User Content at any time. We are not responsible for the content submitted by users or any actions caused thereby.

20. Mobile Messaging (if applicable)

If we offer a text-messaging (SMS/MMS) service, you agree to receive recurring automated promotional and/or customer-service text messages from us. Message and data rates may apply. Your consent is not a condition of purchase. You may opt-out at any time by following the opt-out instructions provided in each message. You agree that we are not liable for any delay or failure in the delivery of any message.

21. Indemnification

You agree to defend, indemnify and hold harmless Abbett, its affiliates, officers, directors, employees, agents and service providers, from and against any claims, liabilities, losses, damages, costs or expenses (including reasonable legal fees) arising out of: (i) your use of the Site; (ii) your breach of these Terms; (iii) your User Content or submissions; or (iv) your violation of any rights of another.

22. Disclaimer of Warranties

THE SITE, ITS CONTENT AND ANY PRODUCTS OR SERVICES SOLD THROUGH THE SITE ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ABBETT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.
Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusion may not apply to you.

23. Limitation of Liability

IN NO EVENT SHALL ABBETT, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS OR AFFILIATES BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGES, LOSS OF PROFITS, LOSS OF DATA, OR OTHER DAMAGES ARISING OUT OF OR IN ANY WAY CONNECTED WITH YOUR USE OF THE SITE, PRODUCTS OR SERVICES, EVEN IF ABBETT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. ABBETT’s TOTAL LIABILITY FOR ANY CLAIM ARISING IN CONNECTION WITH YOUR USE OF THE SITE OR PURCHASES SHALL BE LIMITED TO THE AMOUNT YOU PAID FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM (or equivalent).

24. Applicable Law & Venue

These Terms and your use of the Site shall be governed by and construed in accordance with the laws of Hong Kong SAR, China, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms or your use of the Site must be brought exclusively in the courts located in Hong Kong SAR, China, and you hereby consent to such jurisdiction and venue.

25. Termination

We may, in our sole discretion, suspend or terminate your access to the Site, or any portion thereof, at any time and for any reason, including without limitation for violation of these Terms, with or without notice.
Upon termination, the rights and licences granted herein will automatically cease.

26. Severability

If any provision of these Terms is found to be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable and shall not affect the validity and enforceability of any remaining provisions.

27. Entire Agreement

These Terms constitute the entire agreement between you and Abbett regarding your use of the Site, and supersede all prior or contemporaneous agreements, proposals or communications, whether electronic, oral or written, between you and Abbett regarding the Site.
